Sculptor Bio, Photo, and Indemnity Form

THIS INDEMNITY AGREEMENT is entered into as of the date below between Virginia Beach Events Unlimited, Inc. t/a Virginia Beach Neptune Festival with the Participant listed below.

WHEREAS: During and up to one (1) year following the execution of this agreement, the Participant shall indemnify, hold free and harmless, assume legal liability for, and defend Virginia Beach Events Unlimited, Inc. t/a Virginia Beach Neptune Festival along with its agents, contractors, volunteers, employees, officers, directors, and guests from any and all costs and expenses including, but not limited to, attorneys' fees, reasonable investigative and discovery costs, court costs, and all other sums with which Virginia Beach Events Unlimited, Inc. t/a Virginia Beach Neptune Festival, its agents, contractors, volunteers, employees, officers, directors and guests may pay or become obligated to pay on account of any, all, and every demand or claim or assertion of liability or any claim or action founded thereon arising or alleged to have arisen out of the Participant's performance of this agreement or any act or omission of the Participant, their agents, contractors, volunteers or employees whether such claim or claims, action, or actions be for damages, injury to person or property or death of any persons made by any person, group, or organization whether employed by the Participant or otherwise, or for breach of warranty or breach of contract by the Participant either expressed or implied.
